Érkezett egy kérdés a REACH-el kapcsolatban, amelyről úgy gondolom, több kollégát érinthet, ezért a kérdést és a választ is betettem a blogba:
Kérdés: “Hol, hogyan tudom megnézni, hogy egy gyártó cég előregisztráltatta-e az általa gyártott és forgalmazott veszélyesnek minősülő anyagokat? (Ezt, mint tudjuk 2008. dec. 1-ig lehetett, ill. kellett megtenni.) A magyarországi felhasználó cég erről egyébként írásban nyilatkoztatta a külföldi céget még a határidő lejárta előtt. Most azonban meg szeretnének bizonyosodni, hogy az általuk is használt veszélyes anyagok valóban előregisztráltak-e?”
Válasz: Ezen a linken található a pre-regisztrált anyagok listája. Ez a lista a pre-regisztrációs számokat (ami beszállító specifikus) nem tartalmazza, csak az EC számokat (ami anyag specifikus). Azonban, ha az Önök által 2009-ben vásárolt vegyi anyagok közül van olyan anyag, amit nem találnak meg ezen a listán, akkor sűrgősen telefonon is vegyék fel a kapcsolatot a beszállítóikkal, mert akkor az az anyag nem lett pre-regisztrálva egyetlen cég által sem az EU-ban. Ennek oka lehet, hogy a cég elfelejtette pre-regisztrálni, vagy mentessége van, vagy kevesebb mint 1000 kg-ot gyárt az adott anyagból évente.
A REACH szerint a továbbfelhasználó kötelessége biztosítani, hogy olyan anyagokat használjanak fel, amelyek a REACH követelményeinek megfelelnek. A pre-regisztrációs számokat a továbbfelhasználó csak akkor tudja ellenőrizni, ha azt a beszállító megadja neki, vagy ha továbbfelhasználóként is pre-regisztrál és ezáltal bekerül az adott anyag SIEF fórumába.
A REACH szerint vegyi anyagot vagy készítményt továbbfelhasználók, forgalmazók számára fontos tudni, hogy amennyiben a beszállítóiktól bekérték a pre-regisztrációs számot, azonban a beszállítók azt nem adták meg, de nyilatkoztak, hogy a gyártó vagy importőr pre-regisztráltatta a vegyi anyag vagy készítmény minden komponensét amely pre-regisztrációra kötelezett, akkor ezt a nyilatkozatot jól őrizzék meg, mivel ha bármikor kiderülne, hogy mégsem tette meg a pre-regisztrációt az Önök gyártója, akkor ezzel a beszállítói nyilatkozattal tudják azt bizonyítani, hogy az Önök cége jóhiszeműen vásárolt vegyi anyagot illetve készítményt az adott beszállítótól.
A REACH szerint a pre-regisztrációs számokat nem kötelező megadni a biztonsági adatlapokon, csak a regisztrációs számokat, de regisztrációs számok kiadása 2010-ben, 2013-ban vagy 2018-ban várható. Mindenképpen érdemes tehát bekérni a pre-regisztrációs számokat a beszállítóiktól. Ha a beszállító nem adja meg és nem is nyilatkozik a pre-regisztrációs számok meglétéről, akkor érdemes beszállítót váltani, a későbbi viták elkerülése végett.

So not really on the same topic as your post, but I found this today and I just can’t resist sharing. Mrs. Agathe’s dishwasher quit working so she called a repairman. Since she had to go to work the next day, she told him, “I’ll leave the key under the mat. Fix the dishwasher, leave the bill on the counter, and I’ll mail you the check. Oh, and by the way…don’t worry about my Doberman. He won’t bother you. But, whatever you do, do NOT under ANY circumstances talk to my parrot!” When the repairman arrived at Mrs. Agathe’s apartment the next day, he discovered the biggest and meanest looking Doberman he had ever seen. But just as she had said, the dog simply laid there on the carpet, watching the repairman go about his business. However, the whole time the parrot drove him nuts with his incessant cursing, yelling and name-calling. Finally the repairman couldn’t contain himself any longer and yelled, “Shut up, you stupid ugly bird!” To which the parrot replied, “Get him, Spike!”
