“Ezzel a logikával párhuzamot vonva fordulhat elő, hogy egy kiváló szakértői véleményekkel alátámasztott váddal szemben a védelem olyan szakvéleményt bocsát a bíróság rendelkezésére, amely a nyomozatival szöges ellentétben áll, és erről a szakértőről természetesen rendre leperegnek a vádat alátámasztó szakmai érvek.
Javíthatatlan naivitásra vallana, ha ezt minden esetben csupán a tudomány szerteágazó sokszínűségének tudnánk be. Hogyan sikerül a védőnek rátalálnia pont arra a szakértőre, akinek szakmai álláspontja a nyomozati szakvéleménytől merőben eltér, horribile dictu még egy ötvenmilliós ingatlan ingyenes elkótyavetyélését is gazdaságilag megalapozott döntésnek fogadja el? Netán olyan szinten ásta bele magát a védő a mikroökonómia tudományába, hogy megtalálta az akadémikustól szögesen eltérő elméletet valló rejtett tudományos műhelyt, és tőle kért szakmai állásfoglalást?
Ez bizony tiszteletre méltó lelkiismeretességre vallana, de töredelmesen bevallom, azért sokszor bujkál bennem a kisördög, hogy itt bizony nem ez a helyzet, hanem az, hogy a védelem nem szakvéleményt, hanem védencének megfelelő szakértői megállapítást rendelt. Na, ilyenkor nem (kizárólag szaktudásán alapuló szuverén véleményét képviselő) szakértőről, hanem zsoldosról beszélek. Ezen logika mentén teszek különbséget az ügyvédtársadalomban (a törvényes kereteken belül ügyfele érdekét a legmesszebbmenőkig képviselő) ügyvéd és (a disznóságokat lelkiismeret furdalás nélkül lepapírozó) zsoldos között is.”
Remélem, munkavédelemhez kapcsolódó szakértői tevékenység kivétel ez alól, de a cikk mindenképpen továbbgondolásra érdemes.
- Ha fenti állítások nem igazak, akkor fel kell lépni az ellen, hogy a szakértők szakmai függetlenségét nagy nyilvánosság előtt megkérdőjelezze valaki, mégha ügyész is az illető.
- ha van alapja a fenti állításoknak, az a “szakértő” mint jogi és szakmai fogalom kiüresedését jelenti, egyelőre talán csak az igazságszolgáltatás résztvevői előtt, de idővel bárki előtt.
Ez ellen pláne fel kell lépni, mert ha elterjed, hogy a szakértő megvásárolható, akkor csak az akar szakértő lenni, aki egyébként is megvásárolható, becsületes szakemberek inkább távolt tarják ettől magukat.
Ez nem az én tisztem, mert szakértő nem vagyok, kibicként pedig ebben nem tudok részt venni. Mindenesetre érdemes lenne egy etikai eljárást lefolytatni olyan esetekben, mikor gyökeresen eltérő szakvélemények születnek, pláne objektív esetekben. A szakemebereket biztosan nehezebb lenne “megvezetni” mint a szakkérdésben laikus bírót.
Ha az egyik szakértő tudatlanságból vont le teljesen téves következtetést, ebben az esetben nem biztos, hogy a szakmai tudása alapján méltó a szakértői címre, ha pedig anyagi érdekeltség miatt hajlott az egyik irányba, akkor pedig a hozzállása miatt nem méltó.
Mindenesetre a szakértői cím kiüresedése senkinek nem szolgálja a javát.
